CASL Compliance Policy
Overview: The Canadian Anti-Spam Legislation or CASL is a set of rules designed to control spam or unwanted consumer electronic messages (CEM). It applies to all electronic messages (i.e. emails, texts) that organizations send out in connection with a “commercial activity”. The intention of CASL is to prevent the distribution of CEMs without the consent of the recipient.
Purpose: The purpose of this policy is to ensure that Victoria Lifeline complies with CASL. Victoria Lifeline is committed to safeguarding our clients/caregivers from unwanted spam electronic messages. We strive to ensure that each message provides relevant information for the recipient. This Compliance Policy outlines the guidelines Victoria Lifeline has established for the acceptable use our e-communication tools (such as our e-newsletter or emails sent to prospective clients).
Policy: 1.0 Victoria Lifeline will ensure consent before emailing clients/caregivers/family members. Obtaining consent: According to CASL, consent can either be express or implied. Express consent, “means that a person has clearly agreed to receive a CEM, either in writing or orally. The recipient must take a proactive action to indicate their express consent (in other words, express consent must be obtained through an opt-in mechanism, e.g. signing up for a blog on our website).” Implied consent exists in certain situations which may include, “having an existing business relationship (EBR) based on a previous commercial transaction with the recipient; or having an existing non-business relationship based on, for example, membership in your club, or if the recipient participated as a volunteer for your charitable organization.” 1.1 When given an email address in the course of a business relationship, Victoria Lifeline assumes implied consent to send a CEM based on this existing relationship. 1.2 This implied consent is not permanent; it expires two (2) years after the Existing Business Relationship ends. 1.3 Under CASL, no matter what type of consent we have, whether it’s implied or express, if someone asks to stop receiving messages through an unsubscribe feature or any other form of communication, we must honour that request and stop sending CEMs within 10 business days. 2.0 Victoria Lifeline will act in accordance with CASL on the following criteria: 2.1 Victoria Lifeline must include company contact information in any electronic communication to identify us as the sender, which includes our business name, a mailing address & an e-communication method such as an e-mail address; or a website address; or a phone number. 2.2 Email campaigns (such as our e-news) must include a clear unsubscribe mechanism so the recipient can opt out of receiving future emails from our organization. 2.3 Victoria Lifeline will not use misleading headings when sending out emails (such as a different ‘from name’). 3.0 Best practices 3.1 Victoria Lifeline will use an email marketing platform that automatically hides unsubscribed email addresses from any distribution list. 3.2 Victoria Lifeline’s Electronic Communication Tools are the property of the Victoria Lifeline and may not be used knowingly to violate CASL. 3.3 To ensure Victoria Lifeline’s conformity with the Canadian Anti-Spam Legislation, the Director of Marketing & Development will act as the Compliance Officer. Please forward any concerns regarding the use of electronic communication tools to that officer.
